The Field Rules — Contributing to the Journal
Welcome to Derek Evenwood's Field Journal of Active Woman educational courses. These Terms of Service constitute a legally binding agreement between you (the "Observer" or "Contributor") and Derek Evenwood, an individual entrepreneur registered in Costa Rica (the "Naturalist" or "Proprietor"). By accessing our field journal, submitting an entry, enrolling in any course, or consuming any of our educational content, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not agree with any provision herein, you must refrain from using our services immediately. We reserve the right to modify these terms at any time, and continued use of our services following such changes constitutes acceptance of the revised terms.
The Naturalist offers educational wellness courses focused on improving the physical condition of the female body through structured gymnastics routines and nutritional guidance. Our current catalogue consists of three primary specimens: (a) Specimen AW-001: Daily Gymnastics for Body Slimming (₡5) — a foundational observation of body-slimming exercises; (b) Specimen AW-002: Daily Gymnastics to Support a Lean Body (₡5) — sustained observations for maintaining a lean physique; (c) Specimen AW-003: Nutrition for Slimming (₡10) — comprehensive nutritional guidance. These services are educational and recreational in nature. They are not medical treatments, physical therapy sessions, or professional athletic training programs. The Naturalist is not a licensed healthcare provider, certified fitness instructor, registered dietitian, or medical professional of any kind.
CRITICAL NOTICE: Before submitting your entry to any specimen, you must acknowledge and agree to the following: (a) you have consulted with a qualified medical professional regarding your intention to participate in these exercise and nutrition programs; (b) you have disclosed to your physician any pre-existing medical conditions, injuries, surgeries, medications, or health concerns that might affect your ability to safely engage in physical activity; (c) you understand that exercise carries inherent risks including but not limited to muscle strain, joint injury, cardiovascular stress, and in rare cases, serious medical events; (d) you assume full responsibility for any injury, illness, or adverse health outcome that may result from following our observations; (e) you agree to stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, chest discomfort, or any unusual symptoms during practice. The Naturalist expressly disclaims any liability for health complications arising from participation in our programs. Special consideration is given to female-specific health concerns including pregnancy, postpartum recovery, menstruation, and menopause.
Our courses and field journal are intended for adult women aged 18 years and older. By submitting an entry, you represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into this agreement. If you are enrolling on behalf of a minor, you represent that you are the parent or legal guardian with full authority to make such decisions, and you accept full responsibility for the minor's participation. We reserve the right to verify age and refuse service to anyone who cannot provide satisfactory proof of eligibility. No underage observers will be admitted to the field journal.
All entries are submitted through the Sketchbook form on our field journal website. Course fees are denominated in Costa Rican Colón (CRC) and must be paid according to the payment instructions provided upon entry confirmation. Payment terms are as follows: (a) full payment is required before course materials are delivered; (b) all fees are non-refundable except as required by applicable Costa Rican consumer protection law; (c) cancellations made at least 48 hours before the scheduled course may be eligible for credit toward future observations, subject to availability; (d) no-shows or cancellations within 48 hours forfeit the full course fee; (e) the Naturalist reserves the right to cancel or reschedule any course due to unforeseen circumstances, in which case a full refund or credit will be offered. Entry prices are subject to change without prior notice, but confirmed entries are locked at the rate existing at the time of submission.
All content provided through our courses and field journal — including but not limited to text, graphics, logos, course materials, exercise routines, nutritional guides, videos, and written instructions — is the exclusive intellectual property of Derek Evenwood and is protected by copyright, trademark, and other applicable laws. Upon entry confirmation, you are granted a limited, non-exclusive, non-transferable license to access and use the materials for personal, non-commercial purposes only. You may not: (a) reproduce, distribute, or publicly display any course materials; (b) create derivative works based on our content; (c) sell, license, or commercially exploit our intellectual property; (d) share access credentials or course materials with third parties; (e) record, transcribe, or systematically download course content. Violation of these provisions will result in immediate termination of access and may subject you to legal action for damages.
We maintain a respectful, professional environment in our field journal. The following conduct is strictly prohibited: (a) harassment, discrimination, or abusive behavior toward the Naturalist or other observers; (b) unauthorized recording of observations or distribution of proprietary materials; (c) misrepresentation of health status or medical clearance; (d) use of our services for any illegal purpose; (e) attempts to circumvent payment or access restrictions; (f) spamming, hacking, or otherwise disrupting our website or services. The Naturalist reserves the right to refuse service, terminate enrollment, and ban individuals who violate these standards without refund or compensation. Disruptive observers will be removed from the journal.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEREK EVENWOOD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE OUR SERVICES; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON OUR SERVICES; (c) ANY CONTENT OBTAINED FROM OUR SERVICES; (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC COURSE GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY REGARDLESS OF WHETHER THE LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY OF LIABILITY.
You agree to indemnify, defend, and hold harmless Derek Evenwood, his agents, representatives, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of our services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; (d) any claim that your conduct caused damage to a third party. This indemnification obligation shall survive the termination of your enrollment and these Terms.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Costa Rica, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or our services shall first be subject to good-faith negotiation between the parties. If negotiation fails, the dispute shall be resolved through binding arbitration in San José, Costa Rica, under the rules of the Centro de Conciliación y Arbitraje de Costa Rica. The language of arbitration shall be English. Each party shall bear its own costs, and the arbitrator's decision shall be final and binding. You waive any right to participate in class actions or collective proceedings.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Naturalist regarding our services and supersede all prior agreements, understandings, and communications, whether written or oral.
